…Top Cop fails to comply with High Court order

Yesterday, lawyers for Barry Dataram discontinued their motion in the High Court before Justice Roxanne George-Wiltshire and the man was released mere hours before the court hearing. Dataram was released on $100,000 station bail from the Diamond Police Station lock-ups. Meanwhile, the habeas corpus hearing that was scheduled for noon yesterday for the Commissioner of Police, Henry Greene to show cause why the police should keep Dataram was not continued with. During the court hearing only Dataram and his two lawyers, Vic Puran and Glen Hanoman, were present in the courtroom. Neither the Commissioner of Police nor a representative of the Guyana Police Force was present. This was pointed out to the court by Mr. Hanoman who went on to tell the court that the actions of the Commissioner of Police were contemptuous.

The lawyers then indicated their interest in discontinuing the case and this was granted by Justice George-Wiltshire.
Meanwhile, Dataram has been ordered to report to the Criminal Investigation Department on Monday.
In addition, his lawyers are expected back in the Magistrates’ court on March 4, when Acting Chief Magistrate Melissa Robertson is expected to rule on the provisional warrant issue currently before her.
After Dataram’s arrest on Wednesday last, the Guyana Police Force had made two attempts to secure a provisional warrant in the Magistrates Court. On the first occasion, Crime Chief Seelall Persaud made the application, which was met with strong opposition from Dataram’s lawyers. The following day the police secured the services of Anil Nandlall one hour before the matter was called.
Since the provisional warrant was not issued the police maintained that Dataram was being held in connection with trafficking in narcotics.
His lawyers had raised the concern over the past and present behaviour of the Guyana Police. It was noted by Dataram’s lawyer that this is the third occasion that Dataram was held by the police on ‘provisional warrant’. When their claims are quashed by the High Court they maintain the trafficking in narcotics allegation.
To date, Dataram has never been charged locally with any offence.
